Welcome. These Terms of Use ("Terms") are an agreement between you and Powers Holdings International Inc, a Florida corporation doing business as The AND Brand™ ("we," "us," or "our"). They apply when you visit or use beccapowers.com, go.beccapowers.com, and their pages, forms, calendars, videos, and blog (together, the "Site").
By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. Purchases (including printed books and The Becca Powers® Book Bundle) and free signups are also covered by our Purchase Terms and Refund Policy, including its sections on shipping, refunds, and coupons.
The Site is meant for adults. You must be at least 18 years old to book a call, submit a form, or make a purchase. If you use the Site on behalf of a company or organization (for example, to book a speaker), you confirm that you are authorized to act for it.

Trademarks. Becca Powers® is a registered trademark. The AND Brand™, Portable Authority™, and Pyramid of Un-Potential™ are our trademarks. You may not use these marks, or anything confusingly similar, without our written permission. Other names and logos on the Site belong to their owners.
Limited permission. You may view and share links to Site pages, and you may quote short excerpts with clear credit to Becca Powers® and a link back to the Site. Anything else, including teaching our frameworks or reusing our materials in your own programs, products, or presentations, requires our written permission.
When you submit a form, book a call, share a comment, or send us ideas or feedback ("Submissions"):
The Site includes embedded content such as Vimeo videos, and links to sites such as YouTube. We do not control those services and are not responsible for their content, availability, or privacy practices. Your use of them is governed by their own terms and policies.
Content on the Site is for general educational and informational purposes. It is not legal, financial, tax, medical, or mental health advice, and it does not create a professional or client relationship. Results vary, and we do not guarantee any outcome.

TO THE FULLEST EXTENT ALLOWED BY LAW, The AND Brand™, Becca Powers®, AND OUR TEAM MEMBERS, CONTRACTORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR OPPORTUNITIES, ARISING FROM YOUR USE OF THE SITE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100.
Some states do not allow certain limits on liability, so some of these limits may not apply to you.
You agree to defend, indemnify, and hold harmless The AND Brand™ and its owners, team members, and contractors from claims, losses, and costs (including reasonable attorneys' fees) that arise from your misuse of the Site, your Submissions, or your violation of these Terms or someone else's rights.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules, and by applicable U.S. federal law.

Any dispute will be brought only in the state or federal courts located in Palm Beach County, Florida.
We may update these Terms from time to time. We will post the new version on this page and change the "Last updated" date. Your continued use of the Site after a change means you accept the updated Terms.
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. You may not transfer your rights under these Terms; we may transfer ours as part of a business change. These Terms, together with the Privacy Policy, the Purchase Terms and Refund Policy, and any separate written agreement you sign with us (such as a speaking agreement), are the entire agreement about the Site.
